Urgent advise needed

Dear all,

I am an Australian currently in the process of negotiation for a job offer in Poland. As part of the employment requirement, the company want to employ me as an external consultant which means I will need to set up a "one person company " (dzialalnosc gospodarcza) and apparently I was advised that it is not feasible if I am not a EU citizen. Does anyone know if this is true and if there is any other options I can explore? I was considering also to set up my limited company in UK and today I was advised that it was against the Polish law for me to set up my company in UK and work in Poland, does anyone know that this is true or?

Also does anyone heard about "a combination of contract forms - labour plus civil (with a sister entity)"??? Does it means if I accepted this form of employment I will be paying high personal tax?

I would really appreciated if anyone can explain to me about these matter or share their experience with me.

As an Australian Citizen you can't open a "Dzialalnosc Gospodarcza" in Poland unless you are a permanent resident (over 5 years of residency) here.

Personal Tax will be 18% up to around 80.000 zl in income and then the rate jumps to around 30%...no matter which form of employment - but if you will be providing services through some kind of "personal company" set-up the tax issue is different since you can deduct expenses etc.

But yes, your best bet is to contact someone specializing in this although the company that is planning to hire you should actually be doing this....it's in their best interest because in the end they are the ones who have to pay a huge fine if they employ a foreigner without all the right paper-work.

Hello,
one important question is for how long are you going to be in Poland working for that company, if it's less then for 183 days then there is a possibility to reduce you taxes and pay them in the country of your residency, if Poland has a special agreement signed with you country.
Another question is what are you going to do? Maybe it can be put under so called in polish "umowa o dzielo".

You can always set up a limited company (sp. z o.o. = spola z ograniczona odpowiedzialnoscia) in Poland. There is no restrictions here. Recently the starting capital was decreased and now it's only 5.000PLN!
